These Terms of Use and Privacy Policy (“Agreement”) state the terms and conditions under which you may use this web site (“Site”) and materials copied from it. By accessing, browsing, or otherwise using the Site you acknowledge that you have read, understood and agree to be bound by the Agreement. If you do not agree with the terms of the Agreement, you may not use the Site for any purpose. County Harvest may revise the Agreement from time to time, without notice to you, and will post any revisions on the Site. For the purpose of the Agreement, “County Harvest” includes our subsidiaries and affiliates and their respective employees, directors, officers, and agents.

INFORMATION ON THE SITE IS PROVIDED FREE TO THE PUBLIC, AS IS AND AS AVAILABLE. YOU EXPRESSLY AGREE TO ASSUME THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, ACCURACY OR COMPLETENESS OF THE SITE, LINKED SITES, AND THEIR CONTENT. COUNTY HARVEST DISCLAIMS ALL WARRANTIES AND MAKES NO REPRESENTATIONS OR WARRANTIES FOR THE SITE, LINKED SITES, THEIR CONTENT, OR ANY RESULTS OBTAINED FROM THE USE OF ANY OF THEM. DISCLAIMED WARRANTIES INCLUDE THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.

LIMITATION OF LIABILITY: COUNTY HARVEST IS NOT LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM YOUR USE OF OR RELIANCE ON THE SITE, LINKED SITES, THOSE SITES’ CONTENT, OR THE AGREEMENT. COUNTY HARVEST IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF OR RELATED TO THE SITE, LINKED SITES, THOSE SITES’ CONTENT, OR THE AGREEMENT, REGARDLESS OF THE THEORY OF LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF WARRANTIES OR CERTAIN LIMITATIONS OF LIABILITY; IN THOSE JURISDICTIONS COUNTY HARVEST’S LIABILITY IS LIMITED TO THE GREATEST EXTENT PROVIDED BY LAW. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING IT.

Restrictions on use: The Site contains text, graphics, photographs, logos, and other material (“Content”). You acknowledge that Content is protected by copyright, trademarks, trade names, service marks, or other proprietary rights. You also acknowledge that County Harvest or third parties working with County Harvest retain all rights to Content. You may view and use the Content for your personal, non-commercial use. You may print copies of Content provided you maintain all notices contained in Content, such as copyright or trademark notices. Except as expressly permitted on the Site, you agree not to license, distribute, create derivative works from, transfer, sell, or resell any information or Content obtained from this Site. You may link to the home page of the Site as long as the link does not cast County Harvest in a false or misleading light. You may not mirror or frame any Content contained in this Site without written agreement from County Harvest. You agree not to assert any rights in the Content. County Harvest reserves the right to terminate this Agreement and your access to any part of our Site or the Content, at any time and for any reason. County Harvest also reserves the right to change or discontinue any part or all of this Site of the Content without prior notice or liability.

If you believe any Content on the Site may infringe your copyright or other intellectual property rights, write to help@countyharvest.org with information identifying the claimed infringement. All claims arising out of the Site, linked sites and their content will be governed by the law of New York exclusive of its law on conflict of laws and the law of the United States. Any such claim will be brought in a state or federal court in New York and within a year from when it arose. You irrevocably consent to the jurisdiction of New York state and federal courts.

Privacy policy:

County Harvest is committed to protecting the privacy of our donors, Site users, and others who communicate with us. This Privacy Policy (“Policy”) applies to your use of the Site for any purpose. By visiting the Site, you accept the Policy. We may change the Policy from time to time and will post any changes to the Site. By submitting personally identifiable information from outside the United States, you consent to its transfer to and storage in the United States.

Information we collect: We collect and store personally identifiable information, such as names and addresses, which you provide voluntarily to us. We use cookies, which are digital identifiers we transmit to your computer and which are sent back to us each time you access the Site. Generally, through the function on your web browser, you can decline to accept cookies. By using this Site, you consent to our use of cookies. We receive and store certain kinds of information from email, such as a confirmation that you have opened an email we sent you. If you choose not to receive further emails from us you can unsubscribe from within one of the emails or send a note to help@countyharvest.org .

Information we provide to others: We are not in the business of selling information about our Site visitors. We will share your personally identifiable information if you authorize us to; if it is a necessary operation of the Site, such as to process a credit card donation; or if the law requires us to do so. You may choose not to provide any personally identifiable information to us. However, you may not be able to donate to us via the Site or use other features of the Site. County Harvest does not knowingly collect information from children under 13. We urge parents to monitor the internet use of your children and encourage them not to provide personal information without permission. If you are under 13, please do not submit any personal information to us.

The Policy is subject to all terms in the Agreement. This Agreement is the sole agreement between the parties respecting its subject matter and it supersedes all existing agreements and other communications between the parties.
